Partner terms

These terms are the agreement between your business — the one that holds the partner account — and Steixner Digital LLC, 16192 Coastal Hwy, Lewes, DE 19958, which makes LullaRoute (“we”, “us”). You accept them for your business when you create a partner account, accept an invitation to one, or add credit, and in doing so you confirm that you may act for that business.
1. What you're buying
Sponsored markers: your logo or image, in one of LullaRoute's marker shapes and always labelled “Ad”, shown on the LullaRoute phone app's map near the places you choose, on the schedule you set. Markers are never shown on car screens (CarPlay or Android Auto).
2. Prices, payment and taxes
You buy credit in advance, in US dollars, through Stripe; we never see or store card numbers. Credit is used up as your markers are viewed, at the price per 1,000 views shown when you create a marker — each marker keeps that price — and never beyond the daily budget you set. A single top-up is between $50.00 and $2,000.00, and no more than $2,000.00 may be added in any 24 hours. Prices don't include taxes: where a tax applies, it is shown at checkout and you pay it.
3. Prepaid credit is non-refundable
Credit is non-refundable and can't be exchanged for cash, except where the law requires otherwise — and except this: if we close your account, or stop offering sponsored markers, without you having broken these terms, we refund the credit you haven't used, to the way you paid. Closing your account yourself doesn't make credit refundable. If you dispute a payment with your bank, we may pause your markers until the dispute is settled.
4. What counts as a view
A view is your marker visible on a phone's screen for at least one second, counted at most once per phone, per marker, per hour. Views are counted by the app without identifying anyone; we do not sell or share information about the people who see your marker, and we have none to share.
5. Your content, and our review
You confirm that you have the right to use every logo, image and name you upload, that what you upload and what you tell us about your places is accurate and lawful, and that you may advertise those places. You let us show, resize and crop what you upload so it can appear in the app and in your account. Everything is reviewed before it is shown. LullaRoute is used by families: we decide what is suitable, and we may decline or remove any marker at any time — you are never charged for views a marker didn't get.
6. Your account
Keep your sign-in details to yourself. You're responsible for what is done in your account, including by the people you invite and the roles you give them. Owners can add or remove people at any time.
7. Pausing and closing
You can pause your markers or close your account at any time. We may suspend or close an account that breaks these terms, or that we reasonably believe is being used to mislead or harm people.
8. No guarantee
How often a marker is seen depends on how many people drive near your places, and we don't promise a number of views. The service is provided as it is, and it may sometimes be unavailable.
9. Limits on liability
As far as the law allows, we aren't liable for lost profits or for indirect or consequential losses, and our total liability to you for anything to do with these terms is limited to what you paid us in the 12 months before the claim.
10. Claims about your content
If someone makes a claim against us because of what you uploaded, or because you broke these terms, you'll cover our reasonable costs of dealing with it.
11. Your information
To run your account we keep your business's name; the names and email addresses of the people on it, and their roles; a one-way scrambled form of their passwords, never the passwords themselves; when they last signed in; your markers, places and logos; and the history of your credit. The portal sets one cookie, to keep you signed in. Card payments are handled by Stripe, and our emails are sent through Resend. We don't sell any of this or use it for anything but running your account. To have your account and its data deleted, write to us; payment records are kept for as long as tax law requires.
12. Changes
If we change these terms, we'll email the Owners of every partner account before the change takes effect, and the new date will be shown at the top of this page. Adding credit or keeping markers running after that means you accept the change.
13. Law and courts
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and any dispute goes to the state or federal courts in Delaware.
